Car accident involving tractor-trailer claims a life

The chances of escaping unscathed after a crash involving a car and a tractor-trailer are slim. More often than not, such a car accident will result in fatalities. A 27-year-old driver recently lost her life in such a crash in British Colombia.

The Royal Canadian Mounted Police in Surrey asked any witnesses to the accident to provide information that might assist in the investigation of the collision. The circumstances of the crash or its cause were not reported. Preliminary information simply indicates a collision between a passenger vehicle and a tractor-trailer. Reportedly, the accident occurred around 4 p.m. on a recent Tuesday.

Rescue workers and police were dispatched to the scene of the wreck after it was reported. Officials arrived at the accident scene to find the car and the big rig approximately 300 metres from the point of impact, with debris strewn across the roadway. The driver of the car had not survived the crash. No mention was made about any injuries suffered by the truck driver.

In a case such as this one in which there is preliminary indication regarding who was at fault, proving negligence may be challenging. While the surviving family members may have a viable wrongful death claim against the truck driver and the owner of the vehicle, they will first have to prove negligence on the part of the truck driver. This is where the experience and skills of a wrongful death lawyer are crucial.

A seasoned British Columbia lawyer can launch an independent investigation into the car accident. If the evidence suggests that the truck driver was at fault, the family may file a lawsuit in pursuit of a monetary judgment to cover end-of-life and other damages sustained. Once liability is formally documented, claims for specific items of monetary damages will be considered by the court.
