What kinds of personal injuries can you sue for in Canada?

There are many kinds of injuries you can sue for, and the wrongful death of a loved one can be a cause for litigation. For instance, if your loved one is hit by a car and suffers injuries, that makes the case a personal injury case immediately. If your loved one passes away, then you can also sue for the wrongful death of that person.

Wrongful deaths caused by injuries aren't the only kind of injuries you can sue for. Dog bites, boating accident injuries, auto accident injuries and false arrest injuries can also leave you in a position where you're legally able to seek compensation.

It's important to know that personal injury lawsuits aren't there for physical injuries alone. Emotional trauma is considered an injury, so things like post-traumatic stress disorder, anxiety and other trauma may be used in court as a way to seek compensation. Psychological and emotional trauma can sometimes outweigh the physical damage that has been done, but both may be presented to the court for consideration.

You may sue for several kinds of damages. Pain and suffering, which includes all the pain and suffering, both physical and mental that you went through, is one kind of damage you can sue for. Another includes a loss of income from not being able to work. You may also be able to receive punitive damages if the defendant was behaving maliciously or in an extremely negligent manner. Canada's legal system is conservative with punitive damages, but the award itself is still used as a punishment for especially malicious conduct.
